§ 6-1. Definitions.

  • In this chapter:

    Area I shall mean that portion of the Fairview Cemetery that was constructed prior to 2001 and which is shown as such in the cemetery plat kept in the office of the city sexton and the city secretary, consisting of twenty-six (26) divisions, and located north of Area II.

    Area II shall mean that portion of the Fairview Cemetery opened in 2002 and shown as such in the cemetery plat kept in the office of the city sexton and the city secretary, consisting of four (4) tiers, and located along the southwest one-half of the south boundary of Area I.

    Cemetery shall mean the "Fairview Cemetery," as more particularly described in section 6-4.

    Corner marker means a concrete or other suitable material used by the city to locate corners of the space and/or space.

    Division means a portion of the cemetery, designated by number or letter, shown on the plat, which consists of spaces grouped in lots.

    Interment shall mean the permanent disposition of the remains of a deceased person by cremation and burial or entombment and burial.

    Lot shall mean a group of spaces within a division or tier designated on the plat as a lot.

    Marker means a memorial flush with the ground, generally located at the foot of a space.

    Memorial shall include a monument, marker, tablet, headstone, or footstone, for family or individual use.

    Monument shall include a tombstone or memorial of granite, or other material, which shall extend above the surface of the ground.

    Rubbish shall include trash, debris, rubble, stone, useless fragments of building materials, and other miscellaneous, useless waste or rejected matter.

    Shrub means a woody plant, smaller than a tree, consisting of several small stems from the ground, or small branches near the ground, and may be deciduous or evergreen.

    Space shall apply to a space of sufficient size to accommodate one (1) full interment or two (2) cremations interment.

    Tier means a portion of a division in Area II of the cemetery within which the same space price applies.

    Tree means a woody, perennial plant, ordinarily with one (1) main stem or trunk, which develops many branches, and which ordinarily grows to a height of ten (10) feet or more with a diameter in excess of six (6) inches at a height of five (5) feet. Any self-supporting, woody plant having at least one (1) well-defined stem.

    Vegetation means any tree, shrub, herb, grass, fern, or flower.
