§ 2-11. Market Square.

  • (a)

    Established. The lands described in the deed from O.F. Scott et al., to the city, dated October 13, 1910, and recorded in Vol. 130, page 32 of the deed records of the county, are hereby set apart, designated and established as a market place in and for the city.

    (b)

    Administrator. The city manager or city manager's designee is designated as administrator of the Market Square. The manager or manager's designee shall establish specific regulations to ensure compliance with this section and hours of operation.

    (c)

    Sales. The Market Square's primary purpose is for the sell, offer for sale or display for the purpose of sale or assist in selling products that are finished on the farm or at a home, farm produce, eggs, plants, or prepared food sold from a vehicle/food truck.

    (1)

    The administrator may allow special events at the Market Square that allow for non-home/farm produce, eggs, plants, or prepared food that is not sold from a vehicle/food truck.

    (2)

    Musicians/bands that are performing at the Market Square within the rules established by the administrator shall be able to sell their music and band merchandise during their performances.

    (3)

    No raw meat or live animals shall be sold at the Market Square.

    (d)

    Sales from shed stalls and truck spaces. It shall be unlawful for any person to sell, offer for sale or display for the purpose of sale or assist in the selling, offering for sale or displaying for the purpose of sale any product, merchandise, article, item or thing of value in the Market Square area other than from the shed stalls and truck spaces provided therefore and plainly marked and designated at such places. No food shall be cooked or prepared at Market Square, unless the cooking and preparation occurs inside a vehicle/food truck, unless approved by the administrator for a special event.

    (e)

    Construction. It shall be unlawful for any person to erect, construct, make additions to or alterations of any nature or characteristic whatsoever, whether permanent or temporary, to any shed, stall or any other place in the Market Square area.

    (f)

    Aesthetics and littering. All stalls and food truck spaces shall be maintained in an aesthetically pleasing manner. It shall be unlawful for any person to throw, deposit, dump or discharge any rinds, fruit, paper, boxes, baskets, litter, waste or debris in any stall, Market Square area or parking lane.

    (g)

    Loitering. It shall be unlawful for any person to loiter around the trading area or Market Square area after the hours prescribed for such trading or special event.

    (h)

    Traffic pattern. It shall be unlawful for any person to operate a motor vehicle on any lane on the Market Square in the opposite direction from that provided in this subsection. Other than Chestnut Street in the center of the Market Square, all other traffic lanes thereon shall be one-way thoroughfares as so plainly marked and designated. All traffic on the lane or thoroughfare west of Chestnut Street shall enter from the north or Broadway Street and travel southward leaving the same on Elm Street and from no other direction.

    (i)

    Parking vehicles, etc. It shall be unlawful for any person to park or leave parked any truck, pickup, vehicle or trailer in any stall or designated truck parking space in the Market Square, unless such person has been assigned the booth or designated truck parking space by the city.

    (j)

    Live bands/musicians. Live bands and musicians may utilize the stage for performances between 10:00 a.m. and 10:00 p.m. Sunday through Thursday or 10:00 a.m. through 12:00 a.m. (midnight) on Friday and Saturday. The administrator can allow for musicians to reserve the stage for a performance time. If the stage is not reserved for a performance or special event, musicians shall play on a first come basis. Musicians may accept tips and sell band merchandise during their performances.

    (k)

    Alcohol. The public is allowed to bring alcohol and consume alcohol at the Market Square. The City may disallow outside alcohol from being brought into the Market Square during special events, at which alcohol is being sold.
