§ 17-5. Notice to property owner to construct sidewalk.

All persons owning or controlling property fronting upon any public street in the city, upon order and notice from the city council, shall construct a sidewalk in front of or abutting on the property designated in the order and notice to such property owner or person controlling such property. When any person shall fail or refuse to comply with the notice within the time prescribed therein, the city through its council may construct the same and may sue the party who fails to construct such sidewalk for the cost and expense to the city in the construction of the same, together with ten (10) percent of such amount as attorney's fees.
