§ 14-7. Golf course.

  • (a)

    Definitions. For the purposes of this section, the following terms shall be defined as follows:

    (1)

    Golf course shall mean the Gainesville Municipal Golf Course, located on West Highway 82, near the Gainesville Municipal Airport, in Gainesville, Texas.

    (2)

    Senior shall mean any person age sixty-two (62) or over.

    (3)

    Junior shall mean a person who is a full-time student of public or private secondary schools.

    (4)

    Regular shall mean any person who is neither a junior, nor a senior.

    (5)

    Weekday shall mean any time from Monday through Friday.

    (6)

    Weekend shall mean any time from Saturday through Sunday.

    (7)

    Holiday shall mean any day designated as an official holiday by the United States or Texas Government or the City of Gainesville.

    (8)

    Twilight hours shall mean after 3:00 p.m. during any period in which Daylight Savings Time is applicable or after 2:00 p.m. when Standard Time is in effect.

    (9)

    Standard hours shall mean all non-twilight hours during which the golf course is open to the public.

    (b)

    General administration. The city manager shall appoint a golf course professional, who shall be the head of the golf course. The golf course professional shall be responsible for the management of the golf course, which duties shall include collection of all fees established by the city council for use of the facility, enforcement of the rules prescribed in subsection (c) hereof, manage the maintenance of the golf course, and appoint and supervise any employees whose positions have been approved by the council at the golf course. He shall report to the city manager.

    (1)

    Records and accounts. The golf course professional, or his designee, shall keep a full and complete set of records and accounts in the golf course, which shall be reviewed by the director of finance on a regular basis.

    (2)

    Deposit of receipts. All monies collected for use of the golf course shall immediately be delivered to the director of finance, who shall deposit same to the city's golf course fund, and set aside for use to maintain and improve the golf course.

    (c)

    Rules for use of golf course. The following rules shall govern all persons and players while on the premises known as the Gainesville Municipal Golf Course:

    (1)

    Registration. Prior to using the facility, each person must sign the register and pay the appropriate fee.

    (2)

    Number of players per group. The number of persons which are allowed to play in any one (1) group shall be limited as follows on Saturdays, Sundays and other holidays:

    a.

    April 1 through September 30, four (4) persons per group.

    b.

    October 1 through March 31, five (5) persons per group, unless due to a condition of overcrowding on the course on that particular day, the golf professional, or his designee requires the limit of four (4) persons per group to apply.

    (3)

    Clubs required. Each player shall have a set of clubs designated solely for his use.

    (4)

    Motor vehicles prohibited on greens or fairway. No person shall operate a motor vehicle upon the greens or fairways, except:

    a.

    Vehicles owned and operated by the city; and

    b.

    Motorized carts may be operated on the fairways only.

    (5)

    Sharp heeled shoes. No person shall be permitted to wear any high-heeled, sharp heeled shoe, or other shoe which due to the type of heel or bottom causes or is likely to cause damage to the green or fairways of the golf course upon said greens or fairways.

    (6)

    Practice. Practice shall be limited to a putting green designated therefor and no person shall practice on greens not so designated.

    (7)

    Children. No person under the age of eleven (11) shall be permitted on the golf course unless accompanied by an adult, who shall be responsible for the conduct of such minor child.

    (8)

    Injury to golf course. No person shall intentionally, knowingly or willfully injure the greens, tees or fairways of the golf course.

    (d)

    Fees. Fees and charges for the golf course are approved annually by the city council. A copy of the adopted fee schedule is posted on the city's official website and is on file in the office of the city secretary and with the golf director. Fee schedules are available for public inspection during regular business hours.

    (e)

    Failure to pay fees. Any person who fails to pay the designated charges for use of the golf course may be denied any additional use of said facility until such time as the charge has been paid. Payments made by check or bank draft which is returned for insufficient funds or due to closure of the account shall be subject to a charge.

    (f)

    Penalty and violations. A violation of any of the provisions of subsection (b) of this section shall be deemed a misdemeanor offense, which shall be punishable upon conviction by a fine not to exceed two hundred dollars ($200.00) and each violation shall be deemed a distinct and separate offense and punishable as such.

    (g)

    Sale of alcoholic beverages at the municipal golf course. The sale of alcoholic beverages in or upon the premises of the municipal golf course shall be allowed by persons or entities properly licensed to sell such alcoholic beverages. Such sales shall only be allowed in areas properly designated and identified as appropriate for such activity by the city manager or his designee. The sale of alcoholic beverages in and upon the premises shall be in accordance with all applicable state and local laws, rules and regulations.

    (h)

    Consumption and possession of alcoholic beverages at the municipal golf course. The consumption and/or possession of alcoholic beverages shall be allowed in or upon the premises of the municipal golf course in those areas designated and identified as appropriate for such consumption and/or possession of alcoholic beverages by the city manager or his designee.
