§ 11-69. Prohibited generally.

  • (a)

    Public property. An operator may not stop, stand or park a vehicle:

    (1)

    On a sidewalk.

    (2)

    In front of a public or private driveway.

    (3)

    Within an intersection.

    (4)

    Within fifteen (15) feet of a fire hydrant, unless otherwise marked.

    (5)

    On a crosswalk.

    (6)

    At an intersection within twenty (20) feet of an existing intersecting curb or projection of an intersecting curbline, unless otherwise marked.

    (7)

    Between a safety zone and the adjacent curb or within twenty (20) feet of points on the curb immediately opposite the ends of a safety zone, unless the chief of police has indicated a different length by signs or markings.

    (8)

    Within twenty (20) feet of the driveway entrance to any fire station.

    (9)

    Alongside or opposite any excavation or street obstruction when stopping, standing or parking would obstruct traffic.

    (10)

    On the roadway side of any vehicle that is stopped or parked at the edge or curb of a street.

    (11)

    Upon any bridge or other elevated structure or within a street tunnel or underpass.

    (12)

    At any place where official signs or markings prohibit a stopping or parking.

    (13)

    In any fire lane.

    (14)

    On a public street or public right-of-way, if the vehicle requires a current license plate, tag, registration sticker or number and safety inspection sticker affixed thereto in order to lawfully operate on any public street, road, alley or waterway and which does not have affixed thereto a current, validly issued license plate, tag, registration sticker or number and safety inspection sticker as required by law.

    (15)

    On a public street or public right-of-way for more than twenty-four (24) hours, if the vehicle is inoperative. If such inoperative vehicle is to be considered moved, it must remain for at least seventy-two (72) consecutive hours, at least one thousand (1,000) feet distant from where last parked.

    (16)

    On a public street or public right-of-way, if the vehicle is major recreational equipment, trailer or commercial vehicle.

    (17)

    On a public street or public right-of-way that are less than thirty-two (32) feet wide.

    (b)

    Private property in a nonmultifamily residential district. An operator may not stop, stand or park a vehicle:

    (1)

    In the front yard of a residential zoned property, as defined by the City of Gainesville Zoning Ordinance of the Code of Ordinances, unless such vehicle is parked on a parking space and such vehicle has affixed thereto a current, validly issued license plate, tag, registration sticker or number and safety inspection sticker as required by law for the lawful operation on the streets, roads, alleys and waterways of this state.

    (2)

    In the side or back yard of a residential zoned property, as defined by the City of Gainesville Zoning Ordinance, unless the vehicle is on a parking space and has affixed hereto a validly issued license plate, tag, registration sticker or number and safety inspection sticker as required by law for the lawful operation on the streets, roads, alleys and waterways of this state.

    If such vehicle does not have a current, validly issued license plate, tag, registration sticker or number and safety inspection sticker as required by law for the lawful operation on the streets, roads, alleys and waterways of this state, such vehicle shall be located wholly behind a fence that is at least ninety (90) percent solid so as to screen the vehicle from view from all adjacent streets and neighboring properties to a height of at least six (6) feet, as measured from the ground surface to the top of the fence.

    (3)

    That is inoperative for more than seventy-two (72) hours and if such inoperative vehicle is to be considered moved it must remain for at least seventy-two (72) hours, at least one thousand (1,000) feet distant from where last parked; except, such inoperative vehicle may be parked within a fully enclosed building.

    (4)

    That is a commercial vehicle.

    (5)

    That is major recreational equipment, unless such major recreational equipment is parked on a parking space and such recreational equipment has affixed thereto a current, validly issued license plate, tag, registration sticker or number and safety inspection sticker as required by law for the lawful operation on the streets, roads, alleys and waterways of this state. Such major recreation equipment shall not be parked within twenty (20) feet of the back edge of the curb on a curbed street or within twenty (20) feet of the edge of the improved surface on a street that does not have a curb.

    (6)

    In any manner that allows for any portion of the vehicle to protrude into the street.

    (c)

    On private multifamily zoned, commercial zoned or industrial zoned property an operator may not stop, stand or park a vehicle:

    (1)

    In any multifamily or commercial zoning district, unless such vehicle is parked on an improved parking space (or gravel area which existed as of July 1, 2008);

    (2)

    In any commercial zoning district vehicles on display for sale may be parked on a gravel surface if the lot, tract or parcel or land, or contiguous lots, tracts or parcels of land, under common ownership have a total surface area of at least one (1) acre; or

    (3)

    In any industrial zoning district, unless such vehicle is parked on an improved parking space (or gravel area which gravel area existed as of July 1, 2008). Equipment, inventory, trailers and commercial vehicles may be parked on an improved gravel surface if the lot, tract or parcel or land or contiguous lots, tracts or parcels of land, under common ownership have a total surface area of at least one (1) acre. Vehicles on display for sale may be parked on improved gravel or unimproved surface if the lot, tract or parcel or land, or contiguous lots, tracts or parcels of land, under common ownership have a total surface area of at least one (1) acre.

    (d)

    Exceptions.

    (1)

    Vehicles may be parked on unimproved surfaces on property that is under construction and the owner of the property has a valid building permit from the city for that location.

    (2)

    Construction trailers may park on the city right-of-way, directly adjacent to the construction site, between the hours of 7:00 a.m. and 7:00 p.m., and must remain attached to a vehicle, except:

    a.

    Where prohibited by state law.

    b.

    Where prohibited by signs.

    c.

    Where prohibited by another provision of this chapter.

    (3)

    Any vehicle complying with a traffic signal, sign or devise or the directions of a peace officer, emergency personnel or flagman.

    (4)

    This article does not prevent the parking or standing of vehicles for the purpose of expeditiously loading and unloading.

    (5)

    Vehicles may park in any area that has been approved through the issuance of a special temporary parking permit as outlined in section 11-70.

    (6)

    Vehicle involved in street construction, maintenance and repair equipment used by public service utility companies engaged in repairing or extending public service utilities; to buses when taking on, or discharging passengers at customary bus stops or emergency vehicles.

    (7)

    Gravel (unless such gravel area was in existence as of July 1, 2008) or unimproved surface shall not be used to stand or park any vehicle in multifamily, commercial or industrial zoning districts along Grand Avenue, California Street, or in any historic overlay district.

    (e)

    An operator who stops or parks on a two-way roadway shall do so with the right-hand wheels of the vehicle parallel to and within eighteen (18) inches of the right-hand curb. On one-way streets, vehicles may be parked on left side of the street, with the left-hand wheels within eighteen (18) inches of the curb, unless signs prohibit parking.

    (f)

    No person shall move a vehicle not lawfully under his control into any such prohibited area or away from a curb such distance as is unlawful.
